Question - do you make the person running the app click on an acknowledgment of an EULA of sorts that describes the disclaimer about abuse of the software prior to allowing them to load the app. Talked with my counsel about it - would like to know if this is in place.

Here's the idea she put out there - "Should a person receive a copy of the software - by either someone giving it to their friend, torrent or other illegal download - the person then loads the software and uses it maliciously then certainly that person has not read your disclaimer and will not be aware of the laws pursuant to the product."

This puts the vendor and possibly the affiliate (if it can be known) in some legal trouble - remember "Mafia Wars"? I know - that was copyright infringement. This one is more stringent as it pertains to privacy laws. I would like to know if whoever uses the application is forced to check off that they have read and understand the disclaimer, have agreed and acknowledged that their actions cannot be tied to the vendor or salesperson and are knowledgeable of their state and country specific laws in terms of communications and privacy.... just saying...

As far as I can see Clickbank is downgrading their standards&status and working against their own terms and conditions.

I think you should let the guy do his thing, let karma and law do what it will I'm sure he's balanced his risk vs. reward. I actually disagree re ClickBanks standards, you have no idea how many things they say no to lately compared to before. This is a deregulated topic in a deregulated growing niche, law is per jurisdiction and this is no different than a keylogger to a computer. There's plenty of other products to harp on if you feel this strongly about ISO standards, in fact I'm not sure why you're touching clickbank stuff if you're not comfy with deregulated or gray niches?

Above and beyond the law, think about the average consumer for this: Probably spouses that think their partners are cheating, moms/dads that want to help their kids with their drug/other problems, and a vast array of other things that are socially probable, and people won't look to the law to solve these problems. Having said that I'm sure lot's of people will attempt to use this for illegal purposes... But one can argue that guns don't kill people, people kill people... yet guns are available.

@john247, Just for your information, this kind of spy app doesn't work (we have developed this product so i know) unless someone has access to your phone. No one can spy your mobile remotely without even touching the mobile. So only family members or your employer (who provides phone to their employees) can spy.

This does sound like it has potential, sure there will be some aspects of legality when dealing with multi juristictions but so long as you have some loose disclaimer to point this out that they should comply with all state / fed laws you should be covered.

I would put some more branding on the front page of the models covered, otherwise its pretty solid looking.

Guys, I think the legality, like anything else in this world, is based on the usage.
If an employer installs the spybubble software in the phone his company provides to employees, than I believe it is acceptable (I am no lawyer, but if corporations monitor their employees' Internet usage and phone conversations, I believe the SMB can do that as well)
With that said, if someone will use this software in a phone that is not his/hers, than obviously it is illegal.
The issue between a couple, can be viewed as a partnership, and as such, it is reasonable to think that such a sw is in the grey, but acceptable.
Regarding usage of software with the children's cell phones, I believe there is no dispute that it is ok for the parents to do that.
Again, I am no lawyer, and this is my private opinion, but I believe it is reasonable.
I am sure that if somebody's lawyers would like to raise the legality issue, they will. It doesn't mean they will be right.
I for once, am going to promote this product as it seems like it is answering a need.

I am a newbie on hear and I just want to say that if the product does what it says on the tin which Im sure it does this will be one of those products that are going to make quite a few of us alot of revenue and its positive implications on peoples lives are phenomenal. As one guy has said you a genius and the product is definitely one of the best I have seen promoted through network marketing although It was never referred to me I found it last night when I joined click bank for the first time looking to promote my first products and receive site traffic.

I also purchased the product and it will be used to monitor my nephews phone for whom I am guardian while my sister his mother lives and works overseas. I have had the sneaking suspicion that he has fallen in with the wrong crowd but cannot discipline him without proof or knowing I am justified. He will be baffled when I tell him he can have my iphone!! The slickest kid in the neighborhood may just find that you can teach an older dog new tricks a few that young pups have no clue exist!!
